1. Acceptance of Terms

By accessing or using Citizenly ("the Service"), available at citizenly.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Citizenly is an independently developed educational study tool that provides practice questions and study materials to help users prepare for the civics portion of the United States naturalization test. The Service offers practice questions, audio playback, quiz modes, flashcard modes, and progress tracking in multiple languages.

3. Not Affiliated with the U.S. Government

Citizenly is NOT affiliated with, endorsed by, sponsored by, or in any way officially connected with the United States Citizenship and Immigration Services (USCIS), the Department of Homeland Security (DHS), the U.S. Department of State, or any other federal, state, or local government agency. All official USCIS materials, including the civics test questions, are publicly available at uscis.gov.

The name "Citizenly" and any branding associated with the Service do not imply any government affiliation or endorsement.

4. No Guarantee of Test Results

The Service is provided for educational and practice purposes only. Citizenly does not guarantee, warrant, or promise that using the Service will result in passing the USCIS naturalization civics test or any other examination.

Test outcomes depend on many factors outside the control of Citizenly, including but not limited to: the individual applicant's preparation, comprehension, and performance during their USCIS interview; changes to test questions, answers, or format by USCIS; the specific questions selected by the USCIS officer during the interview; and the officer's evaluation of the applicant's responses.

Users should not rely solely on Citizenly to prepare for the naturalization test. We strongly recommend consulting official USCIS study materials at uscis.gov and seeking guidance from qualified immigration attorneys or accredited representatives when appropriate.

5. Accuracy of Content

While we make reasonable efforts to ensure that the questions, answers, and translations provided through the Service are accurate and aligned with official USCIS materials, we do not warrant that all content is completely accurate, current, or error-free.

USCIS may update test questions, answers, or procedures at any time. Certain answers on the civics test change based on current elected officials, appointments, or other events. Citizenly may not immediately reflect these changes. Users should verify current answers at uscis.gov/citizenship/testupdates before their naturalization interview.

Translations are provided to assist users who are eligible to take the civics test in their native language under the 50/20, 55/15, or 65/20 exemption rules. While we strive for translation accuracy, translations may contain errors or may not perfectly align with USCIS-approved translations. Citizenly is not responsible for any discrepancies between our translations and those used by USCIS or by the interpreter at the applicant's naturalization interview.

6. Not Legal Advice

Nothing provided through the Service constitutes legal advice, immigration advice, or professional counsel of any kind. The information about eligibility rules (50/20, 55/15, 65/20 exemptions), the naturalization process, and citizenship requirements is provided for general informational purposes only.

For legal advice regarding your specific immigration situation, consult a licensed immigration attorney or a Department of Justice (DOJ) accredited representative. You can find legal help through the DOJ's list of recognized organizations at justice.gov or through USCIS at uscis.gov/find-legal-resources.

7. Eligibility to Use the Service

The Service is available to users of all ages. However, account registration may require a valid email address and may be subject to additional verification. If you are under 18 years of age, you represent that you have the consent of a parent or legal guardian to use the Service.

8. User Accounts

When you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate information during registration and to notify us promptly of any unauthorized use of your account.

9. Acceptable Use

You agree not to: use the Service for any unlawful purpose; attempt to gain unauthorized access to any part of the Service; interfere with or disrupt the Service or its infrastructure; reproduce, distribute, or resell any content from the Service without permission; or use automated tools, bots, or scrapers to access the Service.

10. Intellectual Property

The Service, including its design, code, text, graphics, logos, and audio content, is the property of Citizenly and is protected by applicable intellectual property laws. The underlying civics test questions are derived from publicly available USCIS materials and are in the public domain.

You may not copy, modify, distribute, or create derivative works based on the Service or its proprietary content without prior written permission.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Citizenly and its owner(s), developer(s), and operator(s) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or failure to pass any examination, arising out of or related to your use of or inability to use the Service.

In no event shall our total liability to you for all claims arising from or related to the Service exceed the amount you paid to us, if any, in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Citizenly and its owner(s), developer(s), and operator(s) from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Third-Party Services

The Service may use third-party services including but not limited to Supabase (database and authentication), Vercel (hosting), and potentially Stripe (payment processing). Your use of these services is subject to their respective terms of service and privacy policies. Citizenly is not responsible for the practices or policies of third-party service providers.

15. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We also reserve the right to update these Terms at any time. The "Last Updated" date at the top of this page indicates when these Terms were last revised. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.

16. Termination

We may terminate or suspend your access to the Service at any time, for any reason, without prior notice or liability. Upon termination, your right to use the Service will immediately cease.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Hidalgo County, Texas.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
